By accessing, browsing, or making a purchase through our site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not use the Services.

Payment is processed through Shopify’s secure checkout and third-party payment processors. TIY does not store your full credit card information.

You are responsible for all applicable taxes associated with your purchase. Where required by law, TIY will collect and remit applicable sales tax.

Pricing Errors. We reserve the right to correct pricing errors at any time, including after an order is placed. In the event of a pricing error, we will notify you and give you the option to confirm your order at the correct price or cancel for a full refund.

Chargebacks. If you initiate a chargeback or payment dispute with your bank or card issuer for a valid charge, TIY reserves the right to suspend or terminate your account and to dispute the chargeback with supporting documentation. Fraudulent chargebacks may be referred to relevant authorities.

4. Promotions, Discount Codes, and Gift Cards

Promotional Codes. Discount codes are subject to individual terms and expiration dates, are non-transferable, and may not be combined with other offers unless stated otherwise. TIY reserves the right to cancel or modify promotions at any time.

Gift Cards. TIY gift cards are non-refundable, have no cash value, and cannot be exchanged for cash. Lost or stolen gift cards will not be replaced. Gift cards do not expire.

5. Custom and Personalized Products

Customized or personalized products are made to order and are final sale. They are not eligible for return or exchange unless they arrive damaged or defective. By placing an order for a custom product, you confirm that the information you provided (including name, color selections, or custom text) is accurate. TIY is not responsible for errors in custom orders resulting from inaccurate information provided by the customer.

6. Product Availability and Descriptions

We reserve the right to limit quantities, discontinue products, or modify product offerings at any time without notice. TIY is not liable in the event of stock unavailability. While we make every effort to display product colors and details accurately, we cannot guarantee that your device’s display will reflect exact colors.

7. Shipping and Delivery

All orders are subject to our Shipping Policy, available on our website. Delivery timeframes are estimates and are not guaranteed. TIY is not liable for delays caused by carriers, weather, customs, or other circumstances outside our control. Risk of loss and title for products purchased passes to you upon delivery to the carrier.

8. Returns and Refunds

TIY’s Return & Refund Policy governs all refund decisions; the discretion described therein is TIY’s sole and exclusive refund policy.

Email. By creating an account or making a purchase, you may receive transactional emails related to your order. You may also receive promotional emails if you opt in. You can unsubscribe at any time using the link in any email.

SMS. By providing your phone number and opting in to SMS communications, you consent to receive marketing and transactional text messages from TIY. Message and data rates may apply. You can opt out at any time by replying STOP. SMS consent is not a condition of purchase.

10. User-Generated Content and Social Media

If you tag TIY Products on social media, submit reviews, or otherwise share content referencing TIY or its products (“User Content”), you grant TIY a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, and distribute that content across any media channels, including but not limited to Instagram, TikTok, our website, and marketing materials, without compensation to you.

By submitting User Content, you represent that you have the right to grant this license and that your content does not violate any third-party rights, applicable laws, or these Terms. TIY is not obligated to use, display, or maintain any User Content.

TIY will make reasonable efforts to credit creators when reposting user content on social media, but this does not create any obligation or entitlement to compensation.

11. Intellectual Property

All content on the Site — including logos, product names, images, designs, copy, trademarks, and trade dress — is owned by or licensed to TIY Products, LLC and is protected by copyright, trademark, and other applicable intellectual property laws. THE SERVICES AND ALL CONTENT, PRODUCTS, AND INFORMATION PROVIDED THROUGH THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. TIY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TIY does not warrant that the Services will be uninterrupted, error-free, or free from harmful components, or that defects will be corrected. No advice or information obtained from TIY shall create any warranty not expressly stated in these Terms.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TIY, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF TIY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall TIY’s total liability to you for any claim arising out of or related to these Terms or the Services exceed the amount you paid to TIY for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.

15. Force Majeure

TIY shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond TIY’s reasonable control, including but not limited to natural disasters, carrier delays, supply chain disruptions, pandemics, government actions, or other events of force majeure. In such cases, TIY will make reasonable efforts to notify you and fulfill your order as soon as practicable.

16. Indemnification

You agree to defend, indemnify, and hold harmless TIY Products, LLC, its officers, directors, members, employees, agents, affiliates, licensors, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (i) your use of or access to the Services; (ii) your violation of these Terms; (iii) your violation of any third-party rights, including intellectual property or privacy rights; or (iv) any content you submit or transmit through the Services.

TIY reserves the right, at its own expense, to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with TIY’s defense of that matter.

17. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Informal Resolution. Before initiating any formal proceeding, you agree to contact TIY at hello@tiyproducts.com and attempt to resolve any dispute informally. TIY will attempt to resolve the dispute within 30 days of receiving your notice.

Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Austin, Texas, unless otherwise agreed. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. You agree that any arbitration or legal proceeding shall be conducted on an individual basis only and not as a class, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to hello@tiyproducts.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other part of these Terms.

Exceptions. Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction in Travis County, Texas, to prevent irreparable harm pending arbitration.

18. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. To the extent any matter is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.

The Services may contain links to third-party websites or services that are not owned or controlled by TIY. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.

23. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and TIY with respect to the Services and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No Waiver. TIY’s failure to enforce any provision of these Terms shall not constitute a waiver of that provision or of TIY’s right to enforce it in the future.

Export Compliance. The Services are controlled and operated from within the United States. Access from jurisdictions where the Services or any content is illegal is prohibited. You are responsible for compliance with local laws.
